هنشرح فى المقال ده انواع الموكلين وطريقة إجراء التوكيل بطريقه سهله وبسيطه
اولاً احنا عندنا 6 أنواع من الموكلين هنتكلم عن كل واحد فيهم على حده وازاى يتم عمل التوكيل فى المكان اللى يتيح للموكل دا بسهوله
1- موكل مصرى مقيم داخل مصر:-
ودا هيكون معروف ومفهوم للجميع أن الموكل يتوجه لمأمورية الشهر العقارى والتوثيق التابع لها محل الإقامة بتاعه وبموجب الرقم القومى السارى ومستندات الملكية الخاصة بموضوع التوكيل وهيعمل التوكيل بتاعى ولازم هنا نشير أن الدولة وفرت طرق عديدة ومختلفة للمواطن يقدر من خلالها أنه يعمل التوكيل بتاعى زى مثلاً السيارات المتنقلة التابعة لوزارة العدل وموقع مصر الرقمية اللى من خلاله تقدر تكتب التوكيل أون لاين وكمان تكتب التوكيل بنفسك وكمان فى برنامج أرغب فى عمل توكيل اللى من خلاله تقدر تحجز معاد مسبق فى الشهر العقارى وعندنا مكاتب خدمات VIP اللى بيتم فيها عمل التوكيل فى أقل من خمس دقايق وطبعا الرسوم والتكاليف بتختلف فى كل خدمه من الخدمات دى.
2- الموكل العربى ( أو الناطق والمتحدث باللغة العربية ) الموجود داخل مصر :-
ودا بيعامل معاملة المواطن المصرى فى كافة الإجراءات السابقة
3- الموكل الأجنبى المقيم داخل مصر:-
الموكل دا له معاملة خاصة وطبعا لانه غير ناطق وغير متحدث باللغة العربية أول وأهم شئ أن يفضل أنه ياخد صيغة التوكيل من المحامى قبل مايروح الشهر العقارى ودا تفادياً لأى أخطاء تحصل فى صياغة التوكيل ولابد من وجود مترجم مع الموكل الأجنبى ويكون الوظيفة مذكورة بالرقم القومى الخاص بالمترجم وفى حال عدم تواجد مترجم مع الموكل الأجنبى يبقى موجود مكانه أى شخص خريج كلية الأداب أو اللغات والترجمة أو كلية الألسن ويكون معاه شهادة التخرج بتاعته وطبعا لازم يكون اللغة بتاعت الخريج هى نفس لغة الموكل وبعد كده بيتم عمل التوكيل وتوثيقه داخل مأمورية الشهر العقارى.
4- الموكل المصرى المقيم بالخارج:-
بيتوجه للقنصلية الموجوده داخل البلد المقيم فيها خارج مصر وفى الغالب هتكون داخل السفارة وبيتم هناك عمل التوكيل وأغلب السفارات خارج مصر تعمل بنفس السيستم والروتين المصرى المتبع داخل مصر بل ومن الممكن أن يلحق بتلك القنصليات موظفين مصريين للعمل بها وبعد كده يعتمد التوكيل ويتم ارساله الى مصر لتوثيقه فى وزارة الخارجية المصرية أو احدى المكاتب التابع لها وبعدها نقدر نعمل محضر إيداع للتوكيل داخل الشهر العقارى ونستخرج شهادة منه أو صورة رسمية من التوكيل وبعدها نقدر نتعامل بالتوكيل.

5_ الموكل العربى خارج مصر :-
الموكل دا بيتوجه لكاتب العدل الموجود فى بلده ومن ثما يتم عمل التوكيل وبعدين يتوجه لوزارة الخارجية فى بلده لإعتماد التوكيل وبعدها يروح القنصلية المصرية لختم التوكيل هناك وبعدها بيتم إرسال التوكيل لمصر وبرضه هنروح نوثقه فى وزراة الخارجية وبعدها نعمله محضر إيداع بالشهر العقارى.
6- الموكل الأجنبى خارج مصر:-
يفضل هنا أننا نبعت للموكل صيغة التوكيل مكتوبة وياريت لو الصيغة تكون باللغة العربية ومترجمة أيضا للغة المتحدث بها الموكل وبعد كده الموكل ياخد الصيغة دى ويروح بيها على القنصلية المصرية لعمل التوكيل وبعدها يتوجه لوزارة الخارجية فى بلده لإعتماد التوكيل من هناك وبعدين يتم إرسال التوكيل لمصر ولو التوكيل غير مترجم باللغة العربية زى ماوضحنا قبل كده يبقى هنحتاج أننا نترجم التوكيل قبل مانتعامل بيه وبعدين نروح نعتمد التوكيل من وزارة الخاريجة داخل مصر وبعدها برضه نعمل محضر إيداع للتوكيل داخل الشهر العقارى.
ملحوظه هامه:- لو التوكيل اللى جاى من خارج مصر غير معتمد من وزارة الخارجية التابع لها الموكل يبقى لازم الأول نعتمد التوكيل دا من القنصلية التابع له الموكل داخل سفارة دولته فى مصر ودا طبعا إجراء بيطول ومدته بتحدد حسب كل سفارة دولة على حده لأن طبعا السفارة لازم تخاطب وزارة الخارجية فى بلدها للتأكد من أن التوكيل سليم وبعدها تعتمد التوكيل.

1- An Egyptian client residing in Egypt:

Fees and costs vary in each of these services.
2- The Arab client (or Arabic speaking person) located inside Egypt:
He treats the Egyptian citizen as the Egyptian citizen in all previous procedures
3- The foreign client residing in Egypt:
This client has a special treatment, and of course, because he is not a native speaker and does not speak Arabic, the first and most important thing is that he prefers to take the form of the power of attorney from the lawyer before the real estate month goes, in order to avoid any errors that occur in the drafting of the power of attorney, and there must be a translator with the foreign client, and the job is mentioned in the national number of the translator In the event that there is no translator with the foreign client, any person who graduated from the Faculty of Arts, Languages and Translation or the Faculty of Al-Alsun, and who has his graduation certificate, will remain.
4- The Egyptian client residing abroad:-
He goes to the consulate located inside the country in which he resides outside Egypt, and most of the time it will be inside the embassy, and the power of attorney is done there. In the Egyptian Ministry of Foreign Affairs or one of its offices, and then we can make a record of depositing the power of attorney within the real estate registry and extract a certificate from it or an official copy of the power of attorney, and then we can deal with the power of attorney.
5_ The Arab client outside Egypt:
This client goes to the notary public in his country, and then the power of attorney is made, and then he goes to the Ministry of Foreign Affairs in his country to approve the power of attorney, and then he goes to the Egyptian Consulate to seal the power of attorney there, and then the power of attorney will be sent to Egypt, and we will accept it, we will document it in the Ministry of Foreign Affairs and then we will make it a record of deposit in the real estate month.
6- The foreign client outside Egypt:-
It is preferable here that we sent the client a written form of the power of attorney, and I wish if the form was in Arabic and also translated into the language of the client’s speaker. Not translated into Arabic, as we explained before, so we will need to translate the power of attorney before we deal with it, and then we go to approve the power of attorney from the Ministry of Foreign Affairs inside Egypt, and then we will also make a record of depositing the power of attorney within the real estate month.
Important note :- If the power of attorney that came from outside Egypt is not approved by the Ministry of Foreign Affairs to which the client belongs, then the first must be approved by the consulate to which the client belongs inside his country’s embassy in Egypt. You must address the Ministry of Foreign Affairs in her country to ensure that the power of attorney is valid, and then approve the power of attorney.
